Terms of Use for GrowStitch

Applies to: All GrowStitch interfaces — mobile applications, websites, social platforms, SaaS platform, and business management tools.

1. Overview

GrowStitch is a Software-as-a-Service (SaaS) platform that helps boutiques, fashion businesses, and independent designers manage operations (orders, catalogs, communication, billing, analytics). By using any GrowStitch interface, you agree to these Terms. We may update Terms to reflect operational or legal changes; continued use means acceptance.

2. Eligibility & Jurisdiction

Use is limited to individuals/entities who can enter into legally binding contracts. If you are under 18 or legally incompetent (e.g., Indian Contract Act, 1872), access may be restricted.
Jurisdiction: Courts at Delhi, India.

3. Accounts & Registration

Provide accurate information and maintain account security. We may suspend or terminate accounts for violations or risk.

4. Electronic Communications

You consent to receive emails, SMS, or in-app messages for account, security, and service updates.

5. Subscriptions, Billing, Cancellation & Refunds

  • Billing cycle: Monthly/Annual as chosen; auto-renews unless cancelled before renewal.
  • Trials: If offered, convert to paid unless cancelled before trial end.
  • Upgrades/Downgrades: Upgrades prorate immediately; downgrades apply next cycle.
  • Refunds: Generally not provided once a cycle begins, except billing errors or where required by law.
  • Taxes & Invoices: Taxes per jurisdiction; invoices available in Billing.

6. Marketplace Transactions

In addition to platform usage, GrowStitch enables users to purchase products through its Marketplace.
GrowStitch may act as a platform facilitator, aggregator, or reseller depending on the nature of the transaction.

Users acknowledge that:

  • Product listings may be fulfilled either by GrowStitch or third-party sellers
  • GrowStitch facilitates order management, payment processing, and support
  • Payment collection is handled through authorized payment partners
  • Order acceptance is subject to availability, payment confirmation, and internal validation

Users agree that:

  • All purchases are subject to the Marketplace Policy, Refund Policy, and applicable product conditions
  • Pricing, availability, and delivery timelines may vary
  • GrowStitch reserves the right to cancel orders in case of errors, fraud, or operational issues

8. Payments and Settlements

  • Payments are processed via third-party payment gateways
  • GrowStitch does not store sensitive payment data
  • Transactions are subject to authorization and fraud checks

9. Chargebacks and Disputes

  • Users must contact GrowStitch support before initiating chargebacks
  • GrowStitch may submit transaction and delivery evidence to payment partners
  • Fraudulent disputes may result in account suspension and recovery actions

10. Acceptable Use (Summary)

Do not: violate laws/IP; post unlawful/abusive content; spam; distribute malware; attempt to breach security; bypass rate limits or share credentials. Automated use must respect API terms. We may warn, suspend, or terminate for violations. Report abuse: security@growstitch.com or support@growstitch.com.

11. Platform Access, Availability & Changes

We aim for high availability but do not guarantee uninterrupted service. We may modify, suspend, or discontinue features (with notice where reasonable). Access may be suspended for non-payment, risk, or maintenance.

12. Third-Party Services

Integrations (e.g., payment gateways) are provided by third parties under their terms/policies.

13. Intellectual Property & License

GrowStitch and its licensors retain all IP rights. Subject to these Terms and your subscription, we grant a limited, non-exclusive, non-transferable license to use the platform for business purposes.

14. Disclaimers & Limitation of Liability

The service is provided "as is" to the extent permitted by law. We are not liable for indirect, incidental, or consequential damages; our aggregate liability is limited to fees paid in the 3 months preceding the claim, unless prohibited by law.

15. Indemnity

You agree to indemnify and hold GrowStitch harmless from claims arising from your use, content, or breach of these Terms.

16. Governing Law & Disputes

Governing law and forum: Delhi, India, as applicable.

17. Changes to Terms

We may update Terms; material changes will be notified through the service or email.
